中国公益诉讼：概念、理念与发展展望

公益诉讼作为一种广受社会关注的新的社会现象和法律现象,是当下中国法学理论界与实务界的热点问题。由于研究者视野和角度的不同,公益诉讼尚存诸多争议。需要深刻反思的是：表面上看,目前关于公益诉讼的研究与实践呈现出一派繁荣景象,但公益诉讼大多还停留在观念促销的层面,它还没有触及那些应当被认真对待的实质性问题：公益诉讼的概念如何界定,公益诉讼的定位如何安排,公益诉讼的理念如何塑造,公益诉讼的制度如何发展。可以说,上述问题不仅构成一个健全公益诉讼制度应有的基本内容,也是有效构建我国公益诉讼制度亟待破解的带有基础性和根本性的问题。

Public Interest Action in China:Concept, Ideas and Prospect

The public interest action,a new social and legal phenomenon which is widely concerned in soclety,is a hot spot issue in China＇s world of both theory and practice at present.There are still some arguments about public interest actions because of the different visual angles.What is to be profoundly rethought is that most public interest actions nowadays only stay at the level of promotion of ideas,without involving those essential issuses which should be treated seriously,such as how to define the public interest action,how to define the role,how to set up its ideas as well as how to develop the system.In fact,the issues mentioned above are not only the necessary basic contents of a sound system of the public interest action,but also the basic and fundamental issues,which are badly in need of solving,in construction of the system of the public interest action in China.
