“中国法哲学”及其法治思维的形成

为平息在中国有没有“中国法哲学”的争辩,结束当今“西方法哲学在中国”占主流地位的尴尬局面,中国法哲学需要展开对中国法治理论与实践问题的研究.中国法哲学是中国人独特的法治观和方法论,是对欧美“法治和平演变论”和中国“法治捍卫江山论”的理论超越;我们不仅要借鉴西方分析性文化对形式逻辑的重视以及实证主义思维的缜密,也要继承中国整体性文化的优势及其对方法的整合功能;既要把传统中国的和谐道德继承下来,也要吸取西方法哲学关于公平正义的普世价值.中国法哲学的目标不在于有些学者所主张的西方化或中国化,因为这两种思想倾向都难以成就为中国法治建设服务的法治观和方法论.我们需要在历史时空中,立足全球视野,寻找确定中国民主、法治建设的路径,从而避免过度西方化或中国化的可能性误导.

＂Chinese Philosophy of Law＂ and the Formation of the Legal Thinking

In order to quell the debate that there is no ＂Chinese philosophy of law＂ in China, and to end the embarrassing situation that ＂western legal philosophy in China＂ is occupying a dominant position today, Chi- nese legal philosophy needs to research on the issues of Chinese rule of law theory and practice. Chinese phi- losophy of law is Chinese people＇ s unique concept of the rule of law and methodology, and it is a theoretical transcendence to the theon of Europe＇ s ＂peaceful evolution of the rule of law＂ and China＇ s ＂rule of law to defend country＂ ;not only to learn western analytic culture＇s emphasis on formal logic, absorb the careful thinking on positivism, but also to inherit the advantages of Chinese integral culture and its function of integrat- ed approach;not only to inherit the traditional Chinese harmony morality, but also to learn about western legal philosophy＇ s universal values on fairness and justice. Chinese philosophy of law doesn＇ t aim at westernization or chinization advocated by some scholars. Because it is difficult for these two ideological tendencies to become the concept of the rule of law and methodology that service for the Chinese construction of the rule of law. We need space and time in history, based on a global vision, to seek the path that identifying Chinese democracy and legal construction of the path. Westernization and chinization are both likely to mislead the path of Chinese construction of the rule of law.
