略论美国自然资源损害赔偿范围

《清洁水法》、《综合环境反应、赔偿与责任法》、《石油污染法》构建了美国自然资源损害赔偿范围的基本框架。赔偿金的确定过程需经历自然资源损害的识别、资源价值的认定和赔偿路径的选择几个阶段。这一过程也构成了理解赔偿范围——修复费用、过渡期损失和评估费用，分析赔偿全面性的线索。这为我国自然资源损害赔偿制度的建立提供了借鉴。

On Compensation Scope of the Natural Resources Damage or the United States

The Clean Water Act, the Comprehensive Environmental Response, Compensation and Liability Act, and the Oil Pollution Act constitute the basic framework of the compensation scope of the natural resources damage of the United States. The process to determine the compensation is required to go through several stages indicated as i- dentification of the natural resources damage, recognition of the value of the natural resources and choice of the way of compensation,which constitutes a clue to understand the compensation scope （ including the rehabilitation cost, transitional loss and the loss evaluation expense） and to analyze the comprehensiveness of the compensation, and provides a reference for formatting the system on the compensation of natural resources damage of China.
