拆迁补偿争议和解的困境与出路

蕴涵平等、民主、自由和契约理念的和解制度在拆迁补偿争议解决机制中的引入，对于有效化解拆迁矛盾和纠纷，促进社会稳定与和谐无疑具有重要作用。目前，我国拆迁补偿争议和解制度之有效运行尚面临行政价值观念错位、行政和解体系和制度缺失、拆迁补偿争议和解自身制度不完善、房屋拆迁制度设计不合理、相关配套制度滞后等诸多困境。为此，应在转变行政价值观念的基础上，建立健全相关制度，以使我国拆迁补偿争议和解走出困境，有效运行。特别是要制定《城市房屋拆迁管理法》，改革完善房屋拆迁制度。

In particular, we should legislate the ＂the Act of Urban Housing Demolition＂ to improve the system of house demolition.
