中国法治政府建设的新进展——解读2008年温家宝总理《政府工作报告》

2008年3月5日．国务院总理温家宝在十一届全国人大一次会议上作《政府工作报告》时指出：过去五年，民主法制建设取得新进步，依法行政紮实推进．保障人民权益和维护社会公平正义得到加强。2003年3月本届国务院一成立，就把坚持依法行政确定为政府工作的三项基本准则之一．2004年3月22日，国务院发布了指导各级政府依法行政的纲领性文件《全面推进依法行政实施纲要》（以下简称《纲要》）。《纲要》明确提出，全面推进依法行政，经过十年左右坚持不懈的努力，基本实现建设法治政府的目标。几年来，国务院积极推动《纲要》的贯彻落实，大力推进依法行政．法治政府建设取得了重要进展。

China Makes New Progress in Development of Law-Based Government ---An Interpretation of the Report on the Work of the Government Delivered by Chinese Premier Wen Jiabao at the First Session of the Eleventh National People＇s Congress on March 5, 2008

Chinese Premier Wen Jiabao, delivering a Report on the Work of the Government at the First Ses-sion of the 11^th National People＇s Congress （NPC） - China＇s national legisla- ture - in Beijing on March 5, pointed out that over the past five years, progress was made in developing democracy and the legal system and in enhancing law-based government, that greater efforts were made to safeguard people＇s rights and interests and ensure social fairness and justice. Immediately after its establishment in March 2003, the 10^th State Council - the cabinet - defined administration by law as one of the three fundamental norms governing the work of the government. On March 22, 3004, the State Council promulgated the Outline of Program for Full-Scale Promotion of Administration by Law （hereinafter referred to as ＂the Outline of Program＂） as a programmatic document guiding governments at all levels in carrying out administration by law. The Outline of Program specifically provides that that administration by law shall be promoted on a full scale, to basically attain the goal of establishing a law-based government through some ten years of unremitting efforts. Over the past few years, the State Council has actively promoted implementation of the Outline of Program and greatly promoted administration by law, making major achievements in the establishment of a law-based government.
