论医疗水平在司法鉴定中的应用

《中华人民共和国侵权责任法》于2010年7月1日起实施,进一步明确了医疗机构、医务人员的过错责任、免责事项等,在医疗侵权纠纷案件的司法鉴定实践中也相应出现了一些新情况和新问题,通过建立＂医疗机构当时医疗水平的评价体系＂,并通过用具体案例来说明＂当时医疗水平＂在司法实践中的具体应用。

The Assessment on the Quality of Medical Service in Forensic Practice

The harmonious problem on the relationship between hospitals and patients is more and more popular in China,with the increasing cases about the dispute of medical infringement.In order to guarantee the rights of patients,medical workers and medical institutions,the Tort Liability Law of People’s Republic of China was adopted and effective from July 1,2010.The Tort Liability Law stipulated the main contents of the faults and exceptions from liability of medical institutions and medical workers.Consequently,there are some new situations and problems in the practice of forensic examination on the cases of medical infringement dispute.This article established an assessment system on the quality of medical service and explained,through some specific cases,the application of this kind of assessment in forensic practice.
