论司法鉴定体制建立的依据及进一步改革的重点

《决定》施行已经5年。总体上应当肯定,但也有值得总结和检讨之处。除保留了侦查机关所属的鉴定机构外,《决定》基本上关闭了国有资本进入司法鉴定领域的大门,这是值得研究的。建立什么样的司法鉴定体制应当有四方面的依据：司法鉴定机构的本质属性;不同诉讼活动的特点;不同国家的国情;成熟国家的经验教训。以此考察我国现行司法鉴定的体制,应当建立由国家出资的公立性鉴定机构,其与侦查机关所属的鉴定机构以及社会鉴定机构一并构成我国司法鉴定三支队伍,各有分工或侧重,共同担负起我国司法鉴定的任务。
