| 摘 要： | 本文认为构建中国民法的社会基础不仅仅在于对政治国家权力的制约,在私域社会张扬权利更是不能忽视的课题。本文在阐明市民社会和民法的特性及二者间的关系,中国传统私域社会——乡土社会特征的基础上,指出中国私域社会之于市民社会的差距,进而得出本文的结论:实现从乡土社会到市民社会的彻底转变,是构建中国民法社会基础的重大理论问题。
