| 摘 要： | 推定全损和委付是海上保险所特有的制度。前者是基于海上风险的特殊性,从保护被保险人利益出发,对赔偿原则的偏离;后者则是从赔偿原则中派生出来的物权移特制度。如何把握其制度及其间关系,这对海上保险及其合同关系的正确处理具有重要意义。

| Abstract: | Constructive total loss and abandonment are two systems peculiar to marine insurance,The former is a de- viation from compensation principle for the benefit of the insurant in view of the particularity of marine risks,The latter is a system of the transfer of the right in rem which is derived from compensation principle,How to grasp these two systems and their relation is very important for us to handle the matters concerning marine insurance correctly. |
