断裂与弥合:我国集体土地征收补偿逻辑的解构与重构

土地是一种稀缺资源,在我国这样一个人口大国里尤其显得珍贵。随着城镇化和工业化的推进,对土地的需求量突飞猛进,因征收土地而引发的矛盾也越来越多。虽然,《国有土地上房屋征收与补偿条例》的出台有效地解决了城市房屋搬迁补偿问题,但是该条例对于矛盾更加突出的集体土地征收则显得无能为力。从域外征收补偿理论结合我国实际情况展开论证。征收与补偿是一个问题的两个方面,在征收合法且已是事实的前提下,补偿在一定程度上是矛盾的根源,也是目前最难解决的问题,有效的解决方式莫过于完善的法制、健全的机制以及认真对待权利,而其根本则是构建严密的补偿逻辑。

Breach and Bridge:Deconstruction and Reconstruction of the Compensation Logic in Collective Land Expropriation

As a scarce resource,land is especially valuable in China.With the development of urbanization and industrialization,need for land keep rising,and conflicts triggered by land expropriation multiply as well.Although "The Regulations on the Expropriation of Houses on State-owned Land and Compensation" has effectively solved the problems in urban area,yet it is incapable in eliminating the conflicts in collective land expropriation.The principle of land expropriation applied by foreign countries can be learned and combined with the existing situation in China.Expropriation and compensation are two aspects of one question.If the expropriation,as an accomplished fact,is legal,then compensation will be the cause of conflict and the core of the problem.The most effective way to solve such problems is to perfect relative legal system and mechanism,and to treat rights seriously,of which the foundation is constructing valid compensation logic.
