| 摘 要： | 民事审判检察监督制度对于保障法律统一、正确实施发挥着重要作用,完善和规范民事检察监督方式是民事检察制度充分发挥作用的核心问题。检察机关履行监督权只能以法律监督者的角色出现,以确保民事审判的公平公正。要逐步从加强抗诉制度、赋予检察机关必要的权限、适当拓展监督的范围、健全监督途径等方面完善民事检察监督权的行使方式。

| Abstract: | The system of civil procuratorial supervision plays an important role in exercising the law precisely.Perfecting its mode is essential.In order to insure the justness of civil trial,the procuratorial organ can be a supervisor only.To enhance the power of the civil procuratorial supervision,the system must be strengthened,the people's procuratorate must be endowed with necessary power,and the scope of supervision widened. |
