反诉作为我国民事诉讼中的一项重要制度,其内容涉及到原告与被告、提起反诉的条件、强制反诉、反诉的撤销、反诉之反诉、上诉审中的反诉等诸多问题,需要在借鉴其他国家立法经验的基础上,从我国民事司法救济的角度进行立法完善。
