| 摘 要： | 在刑事诉讼实践中,司法人员如何运用证据依据法定证明标准准确地认定案件事实,是一个决定司法裁决正当性的基础性问题。对此,要正确运用证据法定证明标准,在司法实践中就应握以下三点:定案证据的适格性、法律推理的合逻辑性、证据事实符合经验法则。
