循环经济法的基本原则新论

环境安全和资源效率是各国循环经济法的共同价值。环境安全和资源效率价值主要借助于预防优先原则、循环利用原则、合理处置原则、适当分责原则渗透于循环经济法规范之中。预防优先原则强调废物的事前控制,体现的是积极防控的资源环境思维;作为循环经济法基本原则的核心,循环利用原则的实质在于"物尽其用";合理处置原则要求采取适当措施减少无法通过循环方法予以消除的废物的环境危害;适当分责原则旨在使不同的循环经济参与主体承担与其身份相适应的法律义务。

On the Basic Principle of Circular Economy Law

The preference for prevention principle emphasizes prevention in advance and it embodies resources and environment thought of positive prevention ; as the core of foundational circular economy law principle, reusing principle implies ＂materials are used completely＂ ; managing reasonably principle means to reduce the harm of waste to environment by right way ; and separate duties suitably principle signifies that different participants of circular economy should undertake legal duties corresponding to its status.
