论企业组织责任——企业责任的一个核心类型

传统侵权法以自然人的不法行为为调整对象。随着工业化的发展,此种个人侵权法已经无法胜任以风险事故为基础的现代社会的要求,而企业责任成为现代侵权法的核心。企业责任包括企业组织责任、雇主责任和企业危险责任。作为独立侵权形态的企业组织责任的归责原则为客观过失推定,构成要件包括违反组织义务、损害以及二者之间具有因果联系。企业组织义务与社会安全保障义务具有区别。我国未来侵权立法应当规定企业责任、尤其是企业组织责任。
