| 摘 要： | 一般程序与特别程序是民事诉讼程序基本的分类。民事诉讼立法过于重视一般程序而忽视特别程序导致了诉讼程序成为一元化的程序规则,也加剧了一元化的程序与多元化的社会、多样化的纠纷之间的矛盾。民事诉讼法学需要加强特别程序研究,扩大特别程序的适用范围,达到快速、有效地解决民事纠纷的目的。本文对特别程序作论纲式研究,从改革现有特别程序入手,然后将海事诉讼、劳动争议诉讼、人事诉讼纳入特别程序体系,最后将一部分公司诉讼和知识产权审判也纳入特别程序范畴,构建有中国特色的大民事诉讼特别程序体系。
