论转型期中国宪法的经济原则

宪法经济原则是宪法经济制度构造的基础性原则或原理,在整个宪法学体系构建中具有承上启下的重要意义。宪法经济原则可以分为四个原则级,即价值原则、目标原则、辅助原则和周延原则。其中价值原则包括经济自由、经济权利和经济平等;目标原则包括经济秩序稳定原则、经济增长与可持续发展原则;辅助原则包括经济中立原则、市场竞争原则、统一市场原则、宏观调控原则、经济分权原则和经济监督原则;周延原则包括有限政府原则、司法审查与司法公正原则、社会福利原则、环境保护原则和社会秩序稳定原则等。
