论宪法价值的实现

宪法一旦创制生成便开始了宪法价值的实现过程。与宪法实施、宪法实现不同的是,宪法价值实现既关注宪法是否以及在何种程度上对宪法主体发生效应,也强调业已发生的效应是否以及在何种程度上为宪法主体所认知、体悟和认同。宪法价值实现是一个由宪法主体、宪法客体、宪法中介构成的系统,这一系统不仅在一定宪法环境中呈现不同的形态(模式),而且是在宪法实践中发生两重双面作用的有机过程。宪法价值实现是法律机制和非法律机制共同作用的结果,是通过诸多具体途径或方式实现的。

On Realization of Constitutional Value

Once the constitution is created and generated,it begins the process of realizing the constitutional value.Different from the implementation and the realization of the constitution,the realization of constitutional value focuses on whether and to what extent the constitution has an effect on the subject of the constitution,and emphasizes whether and to what extent the effects have been perceived,realized and recognized by the subject of the constitution.The realization of constitutional value is a system composed of constitutional subject,constitutional object and constitutional intermediary.This system not only presents different forms(models)in a certain constitutional environment,but also is an organic process containing two-sided interaction and internal coactions of each aspect in constitutional practices.The realization of constitutional value is the result of the joint action of legal mechanism and non-legal mechanism,realized by many specific ways.
