“设区的市”环境立法的理想类型及其实现——央地互动的视角

设区的市环境立法从规范完善和功能提升出发补强了地方环境治理的有效性。基于全面建设生态文明和依法治理的双重目标约束,央地互动在纵向关系、横向关系和动力机制三个维度上为市级环境立法权设定了方向性约束。市级环境立法必须在制度框架、工具选择、执行过程、主体互动、利益整合等方面做出新的制度设计。为此,必须超越中央立法和地方立法之关系的传统限定,以及中央中心主义和地方自主治理的制度分歧,塑造市级环境立法创新的结构秩序,突出底层环境立法的优先性与上溯能力,提升市级立法权的创新能力。

Ideal Type of Environmental Legislation of “City with Districts” and Its Realization:From Perspective of Central-Local Interaction

City-level environmental legislation strengthens the effectiveness of local environmental governance from the improvement of regulations and functions.Based on the dual objectives of comprehensively building ecological civilization and governing by law,the Central-Local Interaction sets the directional constraint for the city-level environmental legislative power in the three dimensions of vertical relationship,horizontal relationship and dynamic mechanism.City-level environmental legislation must make new institutional designs in terms of institutional framework,tool selection,implementation process,subject interaction,and interest integration.Therefore,it is necessary to go beyond the traditional limitation of the relationship between central and local legislation,and the institutional differences between centralism and local autonomy,to shape the structural order of city-level environmental legislation innovation,highlight the priority and up-tracking ability of city-level environmental legislation,and upgrade the ability to innovate in superficial legislative power to innovate.
