我国现行检警关系模式评析

检警关系是刑事诉讼审前程序中一个十分重要的课题。它直接关联刑事审前程序结构并决定侦查和公诉的模式,同时也将影响、制约审判的程序和结果,最终对刑罚权的实现产生深远影响。我国现行法律规定的检警关系的设计尚不合理,存在着侦查质量不高、法律监督乏力、司法资源浪费、诉讼效率低下等诸多亟待解决的问题,有必要在我国刑事审前程序改革过程中尽快理顺我国现行的检警关系。在我国现行法律框架内,即在现有司法体制和法律基本不变的情况下,适宜通过有关司法解释来完善我国的检警关系,主要是建立检察引导侦查机制,同时强化检察机关对警察机关的监督制约,从而提高审前追诉程序的运作效率,共同服务于追诉的目的。

On the Improvement of the Relations Between Procurators and Policemen

The relations between procurators and policemen play a very important role in the pretrial criminal procedure.They are closely related to the structure of the procedure and determine the mode of reconnaissance while public prosecution.Moreover,they will affect and restrain the judicial procedure and results.Ultimately,they have a significant impact on the exercise of penalty.The relations in effect between the two defined by legal provisions in China are unreasonable due to such problems demanding prompt solution as poor reconnaissance,inadequate legal supervision,waste of judicial resources and inefficient litigation.Therefore,it is necessary to straighten out the current relations between procurators and policemen as soon as possible in the reform of pretrial criminal procedure.At present,within the existing framework of law,that is,the existing judicial system and law mainly remain unchanged,it is appropriate in China to improve the relations,or rather,through establishing a mechanism in which procuratorial work guides reconnaissance while strengthening procuratorial organs' supervision over police organs to raise the operating efficiency of the pretrial procedure,thus jointly serving the prosecutive purpose.
