公安机关贯彻新刑事诉讼法中遇到的问题研究

2013年1月1日开始实施的《中华人民共和国刑事诉讼法》(以下简称新刑诉法)修改的内容几乎涵盖了全部的诉讼制度,对公安机关执法产生了重大影响。2014年广东省警察协会成立了调研组,就公安机关贯彻落实新刑诉一年多来遇到的问题进行深入调研,主要存在犯罪嫌疑人翻供拒供案例明显增加,审讯工作难度增大;证据意识薄弱,执法办案不规范;警察难以适应出庭作证的要求,素质有待提高;涉案财物管理薄弱,物证保存困难;精神病人犯罪现象突出,强制措施难以落实;徐辉案效应不容忽视,存在翻案压力等问题,且成因也较为复杂。公安机关必须切实提高思想认识,积极主动适应,不断提高办案工作规范化,进一步推进新刑诉法的实施。

On the Problems of Public Security Organs in Conducting New Criminal Procedure Law

The amended parts of the newly-implemented Criminal Procedure Law of People＇s Republic of China in January 1,2013 almost cover all the procedural system and have a great impact on the law enforcement of public. In 2014,Guangdong Police Association organized a survey group to investigate the problems of public security organs in conducting the new criminal procedure law and the major findings include the increase of suspects withdrawing a confession or rejecting a confession and interrogation work; the weakness of evidence awareness and the irregulation of law enforcement and case investigation; police＇s difficulty in adjusting to the requirement of appearing in the court as a witness and the improvement of police quality; the weak management of case-involved property and the difficulty of evidence preservation; the increase of crimes committed by mental patients and the difficulty of enforcing forceful measures; the effect of Xu Hui case and the pressure of rejecting a confession. Public security organs shall substantially raise ideological understanding,actively adjust to the new requirement and increasingly improve the standardization of case investigation to further accelerate the implement of new criminal procedure law.
