| 摘 要： | 法官独立原则是构建现代法官制度的理论基础,因历史传统及政治体制等原因,目前我国法官制度已不适应时代的要求。应更新我国法官制度的设计理念,改革法官选任资格、选任方式和保障制度,重构我国现代法官制度的设想。

| Abstract: | The principle of judge independence is the theoretical base of modem judge system.The judge system in China does not keep up with the needs of the times due to its historical tradition and the political system.Therefore,it is necessary to reform the design of judge system,judge qualification system,judge producing ways,judge guarantee system to reconstruct modern judge system. |
