论受贿罪中的“为他人谋取利益”

“为他人谋取利益”是索取财物行为构成受贿罪的主观要件,是非法收受财物构成受贿罪的客观要件。“利用职务上的便利”与“为他人谋取利益”非两个相时独立的构成要件,而是统一于国家工作人员职务行为这一要件之中的两个有机组成部分,是一个独立的要件,即“利用职务上的便利为他人谋取利益”这一职务行为。由于索取型受贿罪与非法收受型受贿罪在犯罪构成上存在差异性,这使得受贿罪的犯罪形态具有多样性和复杂性。

On "making benefits for others" while accepting bribes

"Making benefits for others" is a subjective factor in claiming properties to constitute bribery and an objective factor in illegally accepting properties to constitute bribery. " Taking advantage of one' s position" and " making benefits for others" are not contradictory to each other. They integrate into one organic part of "taking advantage of one's posi tion" , that is, "making benefits for others while taking advantage of one's postion". There exist differences between claiming bribes and illegally accepting bribes, which makes the forms of bribery crimes varied and complicated.
