论犯罪客体的司法价值

目前，许多学者和司法人员都质疑犯罪客体的地位与作用，认为犯罪客体不过是一个巨大而空洞的价值符号。事实上，并非如此，犯罪客体不仅具有重要的立法价值．而且更具有重要的司法价值：区分罪与非罪、此罪与彼罪、犯罪形态、一罪与数罪、刑事和解以及量刑等功能。

On the Judicial Value of Criminal Object

At present many scholars as well as judicial personnel are questioning the role and function of criminal object.They regard criminal object as a giant but hollow symbol.The fact is,however,criminal object not only has great value of legislation but also possesses important judicial value,such as distinguishing crime and non-crime,this crime and that crime,crime status,single crime and plural crime,criminal reconciliation and penalty measurement.
