物权法定原则下中国物权法的应然体系

按照大陆法系的民法传统,物权分为所有权和他物权,他物权又划分为两大部分即用益物权和担保物权,以此为物权法的基本结构框架是没有问题的。但在基本框架之下,应该包括哪些具体的物权类型,是需要我们解决的问题。应对我国物权法的应然体系做以构建,以期对我国的物权立法能够有所助益。

The Ideal system of Chinese Law of Property Under the Real Right Statutory

According to the tradition of civil law in Continental Law System, real right consists of right of ownership and right in a thing under the control of another. And the right in a thing under the control of another includes the usufructuary right and real right for security. Under this kind of basic framework, we should decide how many specific kinds of real right the new real right law should contain. In the article, we try to construct the system of Chinese law of property,which can be beneficial to the improvement of the legislation of Chinese law of property.
