| 摘 要： | 我国民法关于肖像权的规定在理解上存在分歧;对肖像权立法进行逻辑解释,揭示肖像权立法中的法律漏洞;进而探究 我国肖像权立法的旨趣;最后通过伦理解释,找出解决法律漏洞的普适性路径,得出“未经本人同意,不以营利为目的使用公民肖像 的,也可构成侵犯公民肖像权”的结论。

| Abstract: | There exist disputes on the definition of violating the portrait right. The author first points out the legislation loophole by means of logical interpretation. Then the author analyses the value trendy of the legislation. At last, by using the method of the aiming - interpretation and sociology interpretation, the author draws the conclusion: It can be a kind of tort for one to use the others' portrait for non porfits - making purpose without getting the permission of others. |
