| 摘 要： | CAFTA《投资协议》在《争端解决机制协议》的基础上进一步完善了中国东盟自由贸易区独具特色的投资仲裁制度，构成了该自由贸易区内私人投资者与东道国政府争端解决机制中的核心部分。本文重点分析了CAFTA的投资仲裁规则的特点及其法理依据，认为该规则将为私人投资者的权利救济提供制度保障，势必极大推动自由贸易区内投资自由化的顺利开展。
