公共领域中的警察权

从传统警察国到现代法治国的转变意味着重新调整公权力和私权利的分配格局，随着私权利的扩张进入到警察权管控的公共领域，冲突至始而生。公共舆论视野下警察权的行使以公共场所的物理空间为权利的自由基础，以公共舆论的理性达成为权利的原则。警察权的现实转变根源于自由主义理念的深化和新公共管理的运用，最终将保障私权利的安全性和最大化。

Police Power in Public Domain

Changing from traditional police-based state to modern law-based state means reallocation of public power and private power. As private power extends to the public domain of police power, conflicts appear as a result. This article uses two cases to disclose part of police image and the boundary of police power from the perspective of public opinion. The actual transformation of police power origins from the concept of freedom and the application of new public administration.
