社会法的部门法哲学反思

社会法的产生机理、演化变革、功能发展、性质或本体、社会法问题代沟与制度需求、主要理论范式等深层次的反思性问题,应在部门法哲学意义上得到关注,应予以跨学科、批判性的研究。社会法的产生机理在于社会保护本能和社会理性,形成了本文所称的"市场化运动推之,社会保护运动挽之"的制衡关系。其性质为构成维系现代产权制度、经济秩序与保障社会权利之间的社会对价关系或新型社会契约。社会法相关的"问题代沟"理论具有广泛的解释力。中国同时面临三代社会法问题,制度需求强烈,应以全球正在探索的第三代社会法为主要资源,科学建构社会法;借鉴多学科理论范式建构社会法法哲学。

Introspection on the Branch Legal Theory of Social Law

The critical problems of the mechanism,theory paradigms as concerned,evolution,development of functions,nature or noumenon of social law must be taken seriously in the field of the branch legal theory of social law.Interdisciplinary and critical methods should be emphasized.The emergence mechanism of social law lies in the instinct of society protection and social reason and the counterbalance relations of"the market movement pushes the course,the society protection movement draws the course "as concerned in this paper can be found.The nature of social law is social consideration relations or a special social covenant between property rights,economic order and social rights protection.The theory of "problem generation gap of social law"has profound and extensive ability of interpretation.China faces all the three generations of social law problems at the same time and the system requirement is urgent.China should learn from the third generation of social law which is probed in the world and constructs the domestic social law.The Interdisciplinary theory paradigms as concerned should be used for reference in the field of the branch legal theory of social law in China.
