完善我国立宪技术的若干思考

立宪技术的完善是我国现行宪法完善的一个重要方面 ,而立宪技术的完善又涉及多方面的问题。我国宪法的频繁修改固然与许多因素有关 ,但其中一个关键问题就是立宪技术的不完善。这种不完善集中表现在立宪目标、立宪导向、立宪语言 ,以及立宪附带技术等方面。从我国实际情况而言 ,立宪技术的完善应当着眼于明确立宪目标和任务 ,协调政治任务与宪政目标之间的关系 ;对于涉及宪法根本性的问题应作具体规定 ,并使之具有可操作性 ;完善立宪附带技术 ,建立司法审查机制以及正确处理好政策与立宪的关系 ,实现政策指导与制度完善的有机结合等方面 ,并通过立宪技术的完善 ,使我国宪法不断完善。

Improve Legislative Technique in Constitutional Law of our Country

As one of the important aspect in perfecting our constitution,improvement of constitutional drafting techniques is related with various issues.Certainly many factors are involved in our frequent revision of the constitution,but imperfection of drafting techniques has been one of the key factors,which is manifested in the objective,orientation and wording of constitutional drafting as well as other related techniques.Taking the reality into consideration,we should improve our constitutional drafting techniques with an view to define the objective and task,to balance between political tasks and constitutional objectives,to stipulate specifically on fundamental constitutional issues as to be operative,to improve related techniques,to establish judicial review mechanism,to correctly handle the relationship of policy and constitution as to achieve organic combination of policy guidance and systematic improvement,etc.Hence our constitution can be perfected continuously by improving drafting techniques.
