| 摘 要： | "部门法哲学"研讨热潮需要回应,刑事诉讼法哲学研究中逐渐暴露的难题需要应对。我国的刑事诉讼法哲学有广义和狭义之分。刑事诉讼法哲学是刑事诉讼法学与法哲学之间的一个交叉学科,具有刑事诉讼法学与法哲学双重属性。针对刑事诉讼现代化,我国应自觉运用反思方法有的放矢地开展狭义上的刑事诉讼法哲学研究。
