| 摘 要： | 在法治国家建设中,对司法与政治的关系进行合理定位具有重大意义。司法与政治属于两个不同的系统,具有不同的目标追求,二者保持适当距离有助于增进政治的合法性。司法相对独立于政治是司法良好运行的基本前提,通过司法控制政治是现代政治规范发展的重要模式。司法无法脱离政治属性,更不可能去政治化,而应对政治作出适当回应。但绝不能把司法简单等同于政治,更不能把司法看作是政治的附庸。司法虽然承载着政治职能,但司法政治职能的有效发挥是通过相对超然于政治的司法运作机制来实现的。司法政治功能的实现必须以政治对司法的合理尊重、维护司法的应有独立地位为前提,一个淡化对司法的强制控制而注重尊重司法规律的司法,方可能实现政治目标的最大化。
