| 摘 要： | 作为一项外来制度,情况判决在中国的情境之下生存状况如何,需要系统的反思。在案例分析的基础上对我国情况判决的适用状况进行实证分析,审视情况判决的适用现状,分析其存在问题,并对几种流行的改良情况判决制度的方案进行点评,具有不可忽视的现实意义。
