反思与超越:中国语境下行政抵抗权研究

抵抗权在西方国家产生后,先后在政治层面、宪法层面以及行政法层面得到发展。由于无效行政行为存在理论上和实证上的困境,作为程序性权利的抵抗权也存在诸多困境。因此需要设计行政抵抗权制度构建的路线图,并创设相应的结构模型:在《行政程序法》中规定抵抗权制度,完善公民参与机制,以及在行政诉讼中建立"请求宣告无效之诉"制度。

Reflection and Transcendence: On Right of Resistance to Administrative Acts in China

After its birth in western countries,the right of resistance has been developed at levels of politics,institution and administrative law. Invalid administrative acts face the dilemma in both theory and practice and so does the right of resistance,being one of the procedural rights. Therefore,the roadmap of the right of resistance to administrative acts system construction and related structure model are in need,i.e. defining the right of resistance system in the Administrative Procedure Law,improving public participation mechanism,and establishing the system of ‘invalid appeal declaration request’ in administrative litigation.
