论利益衡平视域下湘江流域生态补偿

摘随着社会经济的高速发展，湘江流域上下游地区的生态环境保护和经济发展之间的矛盾和冲突加剧，而生态补偿作为利益平衡机制之一，是解决这一矛盾冲突实现环境正义促进湘江流域地区可持续发展的有效途径。尽管已经开始进行试点工作，但仍需从以下几方面完善湘江流域生态补偿机制：一是尽快出台《湘江流域生态补偿办法》；二是明确湘江流域生态补偿法律关系的主客体；三是明确生态补偿的范围和标准；四是湘江流域生态补偿方式应当多元化；五是完善湘江流域生态补偿的监管、评估和激励机制、建立合理的干部考核机制：六是培养湘江流域公众生态补偿意识。

The Ecological Compensation in Xiangjiang River Basin on Interests Balance

With the rapid development of social economy, the conflicts between ecological envi- ronment protection and regional economic development in xiangjiang fiver basin upstream and down- stream area become more and more serious. The ecological compensation in Xiangjiang fiver basin, as one of the benefit balance mechanism, is an effective way that solve this contradiction , realize en- vironmental justice and promote the sustainable development in xiangjiang fiver basin region. De- spite the pilot work has begun, but we still need to perfect ecological compensation mechanism in xiangjiang river basin from the following aspects： Firstly, The act of ecological compensation in xiangjiang fiver basin should be published.Secondly, It is important to clear legal relationship of eco-logical compensation in xiangjiang river basin between subject and object. Thirdly, we must clear the scope and standard of ecological compensation. Fourthly, The ecological compensation mode of xiangjiang river basin should be diversified. Fifthly, We need to perfect supervision, assessment and incentive mechanism of ecological compensation in the xiangjiang river basin. Sixthly, we should train public consciousness of ecological compensation in xiangjiang river basin.
