| 摘 要： | 《中华人民共和国刑法修正案（七）草案》第11条拟在刑法第388条中增设两类“影响力交易”犯罪行为，加强了对非国家工作人员参与腐败犯罪的打击力度。但此项修改内容自身也存在着一定的问题，诸如第11条采用的修改模式是否合理？其设计的两类“影响力交易”犯罪行为能否满足刑事立法的前瞻性要求等等，有必要对其进行进一步修改完善。
