| 摘 要： | 农地发展权的法理基础、农地发展权的性质的甄别和农地发展权的民法保障等三个方面是解决农地发展权的根本点。从私权的角度论证和分析农地发展权的公法权利的私法定位，从而阐明农地发展权的权利归属。在现行的土地制度和政策下，提出通过在土地产权中创设农地发展权的设计，以解决农民土地权利的保障问题。从权利享有的源头探讨解决农民发展权的根本路径，构建农地发展权为国家在一定范围内干预的原土地所有权人所有的农地发展权的制度，为建设社会主义新农村提供法制性的保障。
