论现代立法中的利益衡量

利益衡量在现代立法中具有重要地位。作为立法的利益衡量是立法者为平衡利益冲突在多元利益主体充分表达利益诉求的基础上，对各种利益进行比较、评价、权衡、选择并进行利益整合的有机统一过程，利益衡量的最终结果是法律规范的产生。立法中的利益衡量包括利益表达和利益整合两个阶段。

As me methodology of legislation, the interest balancing is the process which legislators to compare , evaluate and integrate the interest according to some criterions and procedures for balancing the interest conflicts. The result of interest balancing are the law set up. The legislation includes expression of interest and interest integration in two stages.
