行政诉讼司法建议制度的功能衍化

Functional Evolution of the System of Judicial Suggestion in China

According to the 1989 Administrative Litigation Law, the legal function of judicial suggestion is no more than a judgment enforcement measure. However, this function has been greatly expanded as a result of the change of judicial policy by the Supreme People''s Court since 2000. It is particularly worth mentioning that in practice judicial suggestion works as a quasi-judicial review method in the revision of normative documents. An examination from the perspective of social change shows that the pressure for social stability, judicial mediation policy and the change of the mode of local developmental government have triggered institutional demand for judicial suggestion, and turned it into an important tool in the administrative litigation tool-kit. The functional evolution of judicial suggestion system offered both a valuable institutional sample for legal sociology and background materials for the future development of administrative litigation law.
