正确处理党的领导与依法独立办案的关系

Adhering to the leadership of the party is a main thread running through Xi Jinping’s Thought on Rule of Law.Correctly handling the relationship between the Party's leadership and the independent handling of cases according to law is not only an important part of implementing Xi Jinping's Thought on the Rule of Law,but also a major question that must be answered in judicial theory and practice.The leadership of Communist Party of China(CPC)over judiciary has a solid historical and legal basis and constitutionalfoundation.The Party’s leadership is the fundamental guarantee for independent handling of cases according to law,and the latter itself is the embodiment of the former.To correctly understand the relationship between Party’s leadership and independent handling of cases according to law,it must first be clarified that the Party’s leadership refers to the centralized and unified leadership of the Central Committee of CPC,and the leadership of local committees of CPC over judicial work mainly involves the management of direction,policies,principles and human resources.Party organizations of the judicial organs at all levels must ensure that the Party’s leadership is effectively implemented within such judicial organs to administer personnel,affairs and cases according to laws and regulations,and play an overall role in guidance,management,supervision and guaranty,thus ensuring the the unified and correct implementation of the law.
