萨维尼的法学方法论述评

由于放弃了其早期持有的制定法实证主义，萨维尼关于解释对象、目标和方法的观点与其早期差异明显；法律适用过程也必须是一种“反向还原”的过程，此过程可通过“具体概念”或“类型”作为中介而得以实现。在哲学中，直观和建构始终存在密切的联系，因此在萨维尼的理论中，直观与建构也连接起来，法律体系由此就是一种有机的开放体系，它并非制定法规定的单纯集合，而法律制定、法律适用和法学研究也是一个直观一建构一直观的统一过程。萨维尼的法学方法论与概念法学的法学方法论因此存在很大的差异。
