| 摘 要： | 《鹿特丹规则》引入了货物控制权制度,货物控制权的性质是合同请求权。货物控制权与合同变更有着密切的关系,对货方而言,合同变更权比货物控制权可能更有意义。货物控制权的控制方在一定条件下可以成为运输合同的当事人。

| Abstract: | Right of control is introduced to the Rotterdam Rules and the legal character of the right of control should be petition right on contract.Right of control relates closely to variation to the contract of carriage.To the cargo interests,right of variation to the contract of carriage is more practical.The controlling party can become the party of the contract of carriage under certain circumstances. |
