关于检察权优化配置的几个问题

在明晰检察权法律定位的基础上,针对当前我国检察权配置存在的缺陷,从厘清外部边界和优化内部配置两个角度探讨检察权配置问题,提出完善公诉权、保障职务犯罪侦查权、强化司法监督权、科学设置检察机关内设机构、实行"以条为主"的领导体制等优化检察权配置的建议。

On the foundation of defining the position of procuratorial power's law localization,the author viewed the existence' s flaw of the current procuratorial power.The author discussed the procuratorial power disposition's question fromdefined two angles.One is the exterior boundary,the other is optimum internal disposition.Then the author proposed some suggestions,such as consummating the right of prosecution,ensuring the detection power on crime by taking advantage of duty,strengthening authority of judicature supervisory,scientific establishing the organization of procuratorial agency,carrying out the leadership system of"by the strip primarily".
