| 摘 要： | 新中国宪法是在经济立宪时代中诞生和变迁的,因此,在立法者设计、宪法规范和非公有制经济的发展之间,就形成了最紧密、最根本的关系.通过考察中国宪法50年来对非公有制经济的地位和发展的重大影响--既可以引发和促进,也可以全面遏制--从而提出宪法参与(非公有制)经济应有界限.

| Abstract: | Constitution of new China was established and amended during the era of economic constitution.So there consists of a tight and fundamental connection among the design of lawmakers,constitution's norms and the development of non-public ownership economy.Through reviewing the great influence which constitution of new China brought to the status and development of non-public ownership economy in 50 years,that is either initiation and promotion or strictly restraint,author argues that there needs a bound when constitution participates in economy(e.g.non-public ownership economy). |
