The Option of the Pattern of Constitution at the End of Qing Dynasty and the Cultural Clash between China and the West

Chinese traditional political culture and western constitutional culture are different value system. The former emphasizes the doctrine of monarchical power while the latter is based on the guaranteeing of human rights. The impact of importa- tion of western constitutional culture on constitution at the end of Qing Dynasty functions when the thinking way of taking the essence from the West to China is absorbed into Chinese traditional political system. As a result, its value content and basic function is depreciated and distorted. The constitutional pattern, which takes place in the situation of conflict, integration and interaction of different cultures between China and the West, exerts complex impact on and is profound lesson of the practice of Chinese modern constitution.
