| 摘 要： | 对长期深受丈夫暴力虐待而将其杀死 ,是否属于正当防卫或防卫过当 ,即暴力虐待是否属于“正在进行的不法侵害” ,《刑法》第 2 3 2条中的“情节较轻”中的情节是指“犯罪情节”还是“量刑情节” ,怎样才算“情节较轻” ,进行了深入的探讨。

| Abstract: | A wife kills her husband because of being maltreated for a long time. Is it justifiable defense or unjustifiable self-defense? Namely, does the violent maltreatment belong to unlawful attack? Meanwhile, does the "circumstances of the case are not serious" in the item 232 of the "criminal law" refers to "circumstances of crime" or "circumstances for the discretionary action of sentencing"? What is "circumstances of the case are not serious"? The problem is deeply discussed in this article. |
