土地征收:公平补偿离我们有多远?

当前随着我国工业化和城镇化进程的加快,征收农村土地成为新增建设用地、扩大城市规模的主要途径。但是现行土地征收补偿的不完全性和非公平性,相当程度上造成和加剧了滥用土地征收权,侵犯土地权利人合法权益,危及国家粮食安全、土地合理利用以及社会安定和谐等一系列问题。为了解决上述问题,充分发挥土地资源的经济效益和社会效益,对我国现行土地征收补偿制度的局限性进行研究,并在借鉴国外土地征收公平补偿的成功经验的基础上,结合我国国情,提出构建具有中国特色土地征收公平补偿制度的建议。

Just Compensation for Land Expropriation: Dream or Reality?

In the current progress of industrialization in China,land expropriation becomes the main path to expand the amount of constructive land and extend the scale of city.The imperfection of the compensation for land expropriation results in a series of serious problems in some degree,such as the abuse of land expropriation power,the infringing upon property right of landlord,the hazard of national food supply,the unreasonable exploitation of land and the danger to harmoniousness of society etc.In order to solve the above-mentioned problems and use land resources efficiently,this paper proposes the train of thoughts for the reformation of the compensation for land expropriation at the base of the combination of the international experiences and the real situation in China after the analysis of the imperfection of China's compensation for land expropriation.
