论我国《保险法》中的不可抗辩条款及其适用

我国新《保险法》正式引入了不可抗辩条款,这将对我国保险业务的经营产生深远的影响.但我国对不可抗辩条款的立法比较粗糙,对其司法适用并没有设定具体情形,在保险实践中容易引发争议.立足不可抗辩条款的制度价值,通过考察国外立法规则,对我国保险法上的不可抗辩条款的具体适用做进一步探讨,以期能对该条款的司法适用有所裨益.

On the Incontestablility Cluause in China’ s Insurance Lawand Its Application

In 2009,China’s newly revised insurance law introduced the incontestablility clause,which will have great impact on the insurance business.While,the legislation of contestbaliliy clause in our insurance law is very rough and there is no concrete stipulation of its application,which is easy to cause controversy in insurance affaires.Basing on its values of system and the comparation with overseas’ legislation of contestability clause,the author analyses the incontestability clause,hoping to draw a guidance for its proper applicion in our country.
