论农村妇女土地承包经营权的保护——以承包经营权变动机理与承包经营权物权效力的冲突解决为视角

目前,农村妇女土地承包经营权受到严重侵害。分析其受侵害的原因并提出解决方案,对完善土地承包经营权法律制度,有效保护农村妇女承包经营权益意义甚大。土地承包经营权所承载的使集体成员共同富裕的目标决定了承包经营权的变动应该与成员变动一致。而承包经营权的物权效力使其具有稳定性,其所内含的变动性与稳定性的冲突是妇女承包经营权受侵害的根本原因。针对以上冲突,提出三种解决冲突的方案供学界参考,以期能对保障农村妇女的承包经营权尽微薄之力。
