论矿业权的债权化

矿产资源开发程度直接决定着我国经济发展的规模和速度.良好的法律是矿产资源开发秩序化的有效保障.我国的法律工作者大都认识到矿业权物权立法的重要性,强调矿业权的物权化.在我国现有的法制环境下,以矿业权物权化为基础,同时应当加强矿业权的债权立法.只有两者在功能和作用上互相弥补,才能达到最佳的法治状态.在分析矿业权物权化现状的基础上,提出了矿业权债权化的几点思考以期实现矿业权立法的科学化.

The Trend of the Mineral Right Turning into Creditor's Rights

The development of mineral resource plays an important role to our country economy directly. The good law is the effective safeguard mineral resource development . The most of people know the importance of the real right legislation to the mineral right and stress the attribute of real right to the mineral right. Under the current legal system of our country, we should strengthen the creditor's rights legislation to the mineral right on the condition of the real rights legislation to the mineral right. If the two makes up mutually in the function ,it'll be the ideal legal model .This paper puts forward to some thought on the trend of the mineral right turning into creditor's right on the base of the real rights legislation to the mineral right for the scientific of the mineral right legislation.
